In a single term, the Court has delivered a barrage of decisions that critics argue amount to a sustained assault on the post–Civil War constitutional order.
Birthright citizenship, presidential immunity, Section 3 of the 14th Amendment — all have been thrust back into the spotlight, not because history demanded it, but because the Court's right‑wing majority chose to reopen battles that Reconstruction supposedly settled.
And in the middle of this storm, Justice Ketanji Brown Jackson delivered a concurring opinion that didn't just disagree with Justice Clarence Thomas — it demolished him. Her rebuke wasn't polite, wasn't coded, and wasn't academic. It was a full‑throated historical reckoning, the kind that leaves scorch marks on the page.
Critics of the Court say the stakes couldn't be higher. Donald Trump's return to political viability, they argue, was made possible only because the Court gutted Section 3 of the 14th Amendment in 2024 — the very clause designed to keep insurrectionists out of power.
